2. No Brokerage or Fiduciary Relationship

Using OffMarket Deck does not create a broker-client, agent-client, or fiduciary relationship.
We do not represent buyers or sellers in any transaction.
We do not negotiate deals, draft contracts, or provide transaction services.

3. Due Diligence Obligation

You are solely responsible for:

Verifying all property details, pricing, and financial projections independently
Conducting physical inspections and title research
Confirming zoning, permits, liens, and regulatory compliance
Evaluating the accuracy of ARV, repair estimates, and investment metrics posted by sellers
Engaging licensed professionals (inspectors, attorneys, title companies, accountants) as needed

4. Listing Accuracy

Listings are submitted by third parties. We do not independently verify every claim.
Posted dates, pricing, ARV, and property characteristics reflect the submitter's representation.
We reserve the right to remove listings that appear fraudulent, misleading, or violate our policies.

5. Acceptable Use

You agree not to:

Scrape, crawl, or systematically extract data from the site
Post fraudulent, misleading, or illegal listings
Harass, spam, or misuse contact information of sellers or other users
Circumvent our submission or review processes
Use the platform for purposes unrelated to real estate investment

6. Intellectual Property

Site content, branding, and software are the property of OffMarket Deck.
You may not reproduce, modify, or distribute our content without written permission.
Listing content you submit remains yours, but you grant us a license to display it on the platform.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

Listings are accurate, complete, or current
The site will be uninterrupted or error-free
Any property or deal will meet your investment objectives

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OFFMARKET DECK SHALL NOT BE LIABLE FOR:

Any direct, indirect, incidental, special, or consequential damages
Losses arising from property purchases, investment decisions, or transactions
Damages arising from reliance on listing information

9. Assumption of Risk

Use of the site is at your own risk. Real estate investing involves substantial financial risk. Past performance of similar deals does not guarantee future results.

10. Indemnification

You agree to indemnify and hold harmless OffMarket Deck, its operators, and affiliates from claims arising from:

Your use of the site

Any listing you submit
